TERMS AND CONDITIONS

Big Dog Racing – Performance & Aftermarket Automotive Parts (Australia)

1. Acceptance of Terms

By purchasing, accessing, installing, or using any product sold by Big Dog Racing, the customer (“Buyer”) agrees to be bound by these Terms and Conditions. If the Buyer does not agree, they must not complete the purchase or use the products.

2. Intended Use & Assumption of Risk

All products sold by Big Dog Racing are aftermarket performance parts and are intended for off-road, racing, track, or show use only, unless expressly stated otherwise in writing.

The Buyer acknowledges that:

  • Performance parts may significantly increase stress, wear, and failure risk of vehicle components

  • Vehicle handling, safety systems, emissions compliance, and manufacturer warranties may be affected

  • Use of performance parts involves inherent risks, including risk of serious injury or death

The Buyer voluntarily assumes all risks, whether known or unknown, arising from the purchase, installation, and use of any product supplied by Big Dog Racing.

3. No Mechanical or Professional Advice

Any information, guidance, or recommendations provided by Big Dog Racing (including via website content, email, phone, or social media) are general information only and do not constitute mechanical, engineering, or professional advice.

The Buyer is solely responsible for:

  • Confirming product suitability and compatibility

  • Proper installation and maintenance

  • Safe operation of their vehicle

4. Installation Disclaimer

Big Dog Racing does not provide installation services unless explicitly stated in writing.

Big Dog Racing is not responsible for:

  • Incorrect installation

  • Improper fitment

  • Damage to vehicles, components, or persons arising from installation

Professional installation by a qualified mechanic is strongly recommended.

5. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot be excluded under the Australian Consumer Law (ACL).

However, to the maximum extent permitted by law, Big Dog Racing:

  • Excludes all conditions, warranties, representations, and guarantees not expressly required by ACL

  • Limits its liability, at its discretion, to:

    • Replacement of the goods, or

    • Repair of the goods, or

    • Refund of the purchase price

6. Limitation of Liability

To the maximum extent permitted by law, Big Dog Racing shall not be liable for any:

  • Personal injury or death

  • Vehicle or property damage

  • Loss of income, profits, business, or opportunity

  • Indirect, incidental, special, or consequential loss

This applies whether the claim arises from:

  • Product use or misuse

  • Installation or failure

  • Negligence

  • Breach of contract or warranty

Where liability cannot be excluded, Big Dog Racing’s total liability is limited to the amount paid for the product.

7. No Warranty / Manufacturer Warranty Only

Unless expressly stated in writing:

  • All products are sold “as is” and “as available”

  • Big Dog Racing provides no additional warranties beyond those required by ACL

Any manufacturer warranties are provided by the manufacturer only, and all warranty claims must be directed to them.

8. Returns & Refunds

  • No returns or refunds on:

    • Electrical or electronic components

    • Custom, special-order, or made-to-order items

    • Items that have been installed, used, or damaged

  • Approved returns may be subject to restocking fees

  • Shipping and handling fees are non-refundable

  • Returned items must be unused and in original packaging

9. Racing & High-Performance Use Disclaimer

The Buyer acknowledges that racing, track use, and aggressive driving significantly increase the risk of component failure, injury, and death.

Big Dog Racing accepts no responsibility or liability for damages arising from racing, competition, track days, or high-stress vehicle operation.

10. Compliance With Laws & Regulations

The Buyer is solely responsible for ensuring compliance with:

  • Australian Design Rules (ADR)

  • State and territory road laws

  • Emissions and environmental regulations

Big Dog Racing is not responsible for defects notices, fines, penalties, or legal consequences arising from non-compliant use.

11. Indemnity

The Buyer agrees to indemnify and hold harmless Big Dog Racing, its owners, employees, and affiliates from any claims, losses, damages, liabilities, or legal costs arising from:

  • Use or misuse of products

  • Installation or operation

  • Breach of these Terms

  • Violation of any law or regulation

12. Online Store & Orders

Big Dog Racing reserves the right to:

  • Cancel or refuse any order

  • Correct pricing or listing errors

  • Limit quantities or discontinue products without notice

13. Governing Law

These Terms are governed by the laws of Australia, and the courts of the relevant Australian state or territory shall have exclusive jurisdiction.

14. Severability

If any provision is found unenforceable, the remaining provisions remain in full force and effect.

15. Changes to Terms

Big Dog Racing may update these Terms at any time. Continued use of the website or products constitutes acceptance of the updated Terms.
